Terms of Service
These Terms of Service (the “Terms”) are an agreement between you and Denali Digital Bilişim Limited Şirketi (“Denali Digital”, “we”, “us”), a company established under the laws of the Republic of Türkiye, with its address at YENİ BAĞLICA MAH. ÇAMBAYIRI CAD. NO:126 İÇ KAPI NO:17 ETİMESGUT / ANKARA / TÜRKİYE.
They govern your use of Heritage: this website at heritage.denalidigital.co, the Heritage web app, the Heritage mobile apps for iOS and Android, and the reports, images and other features they provide (together, the “Service”).
By using the Service or making a purchase, you agree to these Terms and to our Privacy Policy. If you do not agree, please do not use the Service.
1. Who can use Heritage
You must be at least 16 years old to use the Service. If you are under 18, or under the age of majority where you live, you may use it only with the permission of a parent or legal guardian, who must agree to these Terms and make any purchase for you.
The Service is for your personal, non-commercial use.
2. What Heritage is, and what it is not
Heritage creates personalised, AI-generated reports and images from the photos and answers you provide. They include an Ancestral Profile, Ancestral Insight, Best Place to Live, Your Past Life, Your Ideal Partner, Your Future Lover, Your Future Kid, Surname Heritage and All Of Your Heritage, and Photo Revive restores old photos. Heritage also lets you build a family tree.
Important: Heritage is for entertainment, curiosity and personal reflection.
- Every report and image is generated automatically by artificial intelligence from a photo and your answers. It is a creative interpretation that may be inaccurate, incomplete or fictional, and it is not a statement of fact about you or anyone else.
- Heritage is not genetic or DNA testing. It does not analyse DNA or any biological sample, and it does not verify your ancestry against genealogical or historical records.
- Results about origins, traits or appearance do not establish anyone’s ethnicity, nationality, identity, health or relationships.
- Nothing in the Service is scientific, medical, psychological, legal, financial or other professional advice. Do not rely on it to make decisions about your health, relationships, family, money or where to live.
3. Your account
We create an account for you automatically, linked to your device or browser: in the apps when you first open them, and on this website when you start to use a “Try it” button (see section 2.2 of our Privacy Policy). Where the Service offers it, you can save this account with Apple, Google or an email address so that you can sign in on other devices.
You are responsible for keeping access to your account and devices secure, and for what happens through your account. Tell us at support@denalidigital.co if you think someone else has used it.
You can delete your account at any time in the settings of the app or the web app. This signs you out and removes the account from that device. To have your account and its data erased from our systems as well, email support@denalidigital.co (see section 7 of our Privacy Policy). Deleting your account does not cancel a subscription (see section 6.5).
4. Your photos and other content
You keep ownership of the photos, answers, family tree entries and other content you add (“Your Content”). You give us a limited, worldwide, royalty-free licence to store, process and transform Your Content only to provide the Service to you, including sending it to the AI providers that generate your results (listed in our Privacy Policy). This licence ends when Your Content is erased from our systems, which you can ask for at any time (see section 3), except for copies we must keep by law.
Whose photos you may upload. You may only upload:
- photos of yourself;
- photos of other people who have agreed to you using their photo in Heritage (for a child, their parent or legal guardian must agree); and
- historical family photos, such as photos of ancestors, that you have the right to use.
You confirm that you have every right and permission needed for Your Content, and that it does not break any law or anyone else’s rights.
We do not use your photos to recognise or identify people, we do not create biometric identifiers from them, and we do not sell them or use them for advertising. We may remove content that breaks these Terms.
5. Acceptable use
You must not use the Service to:
- upload photos of anyone without the permission described in section 4;
- upload content that is unlawful, sexual, violent, hateful, harassing or defamatory, or that infringes anyone’s intellectual property, privacy or other rights;
- upload any content that sexualises, exploits or endangers children;
- impersonate anyone, create deceptive media, or present a generated image or report as a real photo of, or a fact about, a real person;
- present results as verified ancestry, identity or DNA information, or use them to profile, discriminate against, harass or make decisions about other people;
- collect, publish or reveal other people’s personal data without their permission;
- copy, resell, scrape, reverse engineer or interfere with the Service, its security or its payment systems, or upload malware or any other harmful code;
- try to get around the Service’s safety filters, usage limits or payments; or
- do anything unlawful, fraudulent or harmful.
Reporting content. If you believe that content in Heritage shows you without your consent, or infringes your copyright or other rights, email support@denalidigital.co. Please describe the content (a copy or a link helps), explain why you are entitled to ask (for example, that the photo shows you or that you own its rights) and tell us how to reach you. We review every report and remove content where appropriate. We close the accounts of users who repeatedly break these rules or infringe other people’s rights.
6. Plans, payments and Paddle
6.1 Purchases on this website
Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders.
For purchases on this website, Paddle sells the subscription to you, takes your payment, calculates and collects any sales tax or VAT, issues your receipt and invoice, and handles billing questions, cancellations and refunds together with us. Paddle’s Buyer Terms apply to your purchase in addition to these Terms.
6.2 Plans and prices
On this website we currently offer:
- Weekly: $6.99 per week.
- Yearly: $39.99 per year, starting with a 3-day free trial.
From time to time, the checkout may also offer:
- Yearly, at a reduced price: $29.99 per year.
- The All Of Your Heritage report: $9.99, a one-time payment.
Prices are in US dollars. Paddle may show the price in your local currency, and it shows any taxes that apply before you pay. The price and terms shown at checkout apply to your purchase.
6.3 Automatic renewal
Subscriptions renew automatically at the end of each billing period (every week or every year), and Paddle charges the payment method you used, until you cancel. If we change the price of your plan, we will tell you before the new price applies to your subscription, and you can cancel before it takes effect.
6.4 Free trial
The Yearly plan starts with a 3-day free trial. You are not charged during the trial. Unless you cancel before the trial ends, your subscription starts automatically and you are charged $39.99 for your first year. Free trials are for new subscribers, and we may limit them to one per person.
6.5 Cancelling
You can cancel at any time:
- in Heritage, under Settings → Manage subscription (in the web app or the mobile apps), which opens your subscription with Paddle;
- with the subscription link in your Paddle receipt email;
- at paddle.net, by looking up your order; or
- by emailing support@denalidigital.co.
Cancelling stops future renewals. You keep access until the end of the period you have already paid for. Deleting the app, the web app or your account does not cancel a subscription.
6.6 Refunds
You can ask for a full refund within 14 days of any charge made on this website. Our Refund Policy explains how.
6.7 Your report allowance
Creating a report uses credits, shown in the app as coins, from the allowance included in your plan. Your plan’s credits are added when your subscription starts and again each time it renews; unused credits do not carry over to the next billing period. A one-time purchase adds the credits for what you bought. Credits are part of your purchase, not money: they have no cash value and cannot be sold, transferred or exchanged for money. We may also give new accounts a small number of free credits.
6.8 Purchases in the mobile apps
If you subscribe or buy in the iOS or Android app, the purchase is made with Apple or Google under their terms. You manage, cancel and request refunds for those purchases with Apple or Google; we cannot refund them ourselves.
7. Our intellectual property
The Service, including its software, design, AI workflows, text, graphics and the Heritage name and logo, belongs to Denali Digital or its licensors. We give you a personal, non-exclusive, non-transferable and revocable licence to use the Service under these Terms. You may save and share the reports and images created for you for personal, non-commercial purposes.
8. Third-party services
The Service relies on third parties, such as Paddle for payments on this website, Apple and Google for app store purchases and sign-in, and AI providers that generate results. Their own terms may also apply. We are not responsible for third-party websites you reach from the Service.
9. Availability and changes to the Service
We work to keep Heritage running well, but the Service is provided “as is” and “as available”. We do not promise that it will be uninterrupted or error-free, or that results will meet your expectations. We may change, add or remove features. If we stop providing the Service altogether, we will give you reasonable notice where we can and refund the unused part of any prepaid subscription period.
10. Limitation of liability
To the extent the law allows, Denali Digital is not liable for indirect, incidental, special or consequential losses, for loss of data, or for decisions you make based on AI-generated results. Our total liability for any claim relating to the Service is limited to the amount you paid for the Service in the 12 months before the claim.
Nothing in these Terms limits liability that cannot be limited by law, such as liability for fraud or for death or personal injury caused by negligence, or your mandatory rights as a consumer.
11. Responsibility for your use
To the extent the law allows, you agree to compensate Denali Digital for claims and losses caused by Your Content or by your breach of these Terms.
12. Suspension and termination
We may suspend or close your account if you seriously or repeatedly break these Terms, if a payment fails or is reversed, if we reasonably suspect fraud or misuse, or if it is needed to protect the Service or other people. Where it is reasonable, we will tell you first. You may stop using the Service and delete your account at any time.
13. Changes to these Terms
We may update these Terms, for example when we change the Service or when the law changes. We will publish the new version here with a new date and, for important changes, tell you in the Service or by email before they take effect. If you do not agree to the changes, you can cancel your subscription and stop using the Service; continuing to use it means you accept them.
14. Governing law and disputes
These Terms are governed by the laws of the Republic of Türkiye. The courts and enforcement offices of Ankara have jurisdiction. If you are a consumer, you also keep the protection of the mandatory laws of the country where you live and may bring a claim before the courts or consumer bodies (in Türkiye, the consumer arbitration committees) that are competent for you. Please contact us first: most issues can be solved quickly.
15. General
These Terms, together with our Privacy Policy and Refund Policy, are the whole agreement between you and us about the Service. If a provision is found invalid, the rest stays in force. If we do not enforce a provision straight away, we can still enforce it later. We may transfer our rights and obligations under these Terms to a company that takes over the Service, without reducing your rights.
